1. Agreement to Terms
​
By accessing or using hometableapp.com ("HomeTable," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use HomeTable.

These Terms apply to all visitors, diners, and kitchen operators who access or use the HomeTable platform.
​
2. What HomeTable Is
​
HomeTable is a discovery and connection platform that helps users find and connect with licensed Microenterprise Home Kitchen Operations ("MEHKOs") and other licensed home kitchen operators in California.
​
HomeTable intends to operate in compliance with all applicable California laws governing Internet Food Service Intermediaries (IFSIs) under California Retail Food Code Section 114367.
​
HomeTable does not:
​

Process payments between diners and kitchen operators

Handle, manage, or fulfill food orders
-
Manage reservations or scheduling
-
Provide or arrange food delivery services
-
Operate, manage, or employ any home kitchen or kitchen operator
-
Guarantee food quality, food safety, or the accuracy of any listing
-
Verify permits or licenses directly with government agencies

All arrangements, including orders, payments, scheduling, pickup, and any other transactions, occur directly between diners and kitchen operators. HomeTable is not a party to any transaction between users.

3. MEHKO Licensing Requirements
​
California law requires that all home kitchen operators listed on HomeTable hold a valid permit issued by the applicable county environmental health agency under California Retail Food Code Chapter 11.6.
​
Kitchen operators are solely responsible for:

Obtaining and maintaining a valid MEHKO permit or applicable home kitchen permit

Complying with all requirements of their issuing county environmental health agency
-
Renewing their permit annually as required by law and local regulation
-
Complying with all applicable California laws and local ordinances

HomeTable does not issue permits, approve applications, or certify the validity of any permit. Diners are encouraged to independently verify the current permit status of any kitchen operator before placing an order.

4. Permit Information and Health Permit Number
​
Kitchen operators are required to provide the following information in their HomeTable listing:

Name of the county environmental health agency that issued the permit

Permit expiration date (recommended)

Kitchen operators are responsible for ensuring that all permit information displayed on their listing is accurate, current, and updated promptly when permits are renewed or modified.

HomeTable may display permit information as provided by kitchen operators. HomeTable does not independently verify the authenticity, validity, or current status of any permit number or issuing agency with government authorities.
​
HomeTable will notify kitchen operators of the requirement to update their permit information annually.
​
5. Platform Fees and Services
​
HomeTable offers the following listing plans:
​

Free Listing: $0 — Basic directory listing with standard features

Premium Listing: $29.99/month — Enhanced listing with additional visibility and features. — Pricing may vary and is displayed at the time of purchase

HomeTable does not charge transaction fees, take commissions on food sales, or process payments between diners and kitchen operators.

All fees listed are for HomeTable platform listing services only. Fees are subject to change with notice to registered users.
​
6. Insurance
​
HomeTable does not carry liability insurance covering incidents arising from the sale or consumption of food listed or promoted on the platform.
​
Kitchen operators are solely responsible for obtaining appropriate liability insurance to protect themselves, their business, and their guests. HomeTable strongly recommends that all kitchen operators obtain general liability insurance before listing on the platform or conducting any food sales.
​
HomeTable's platform listing services are provided without any insurance coverage for kitchen operators, diners, or third parties in connection with food preparation, sale, purchase, consumption, pickup, or any other activity related to a listed kitchen.
​
7. Food Safety and Complaints
​
HomeTable is a discovery platform only. HomeTable does not inspect, certify, regulate, or monitor food preparation activities at any listed kitchen.
​
Reporting a Food Safety Concern
​
Consumers may report food safety concerns related to a listed kitchen by:

Contacting the applicable county environmental health department directly

HomeTable's Legal Obligations as an IFSI
Â
In compliance with California Retail Food Code Chapter 11.6, HomeTable will:
​

Submit to the applicable local enforcement agency ("LEA") the name and permit number of a kitchen operator if notified by the LEA of significant food safety complaints from a verified consumer who made a purchase through the HomeTable platform
-
Submit to the applicable LEA the name, permit number, and a list of consumers who purchased food on the same day, if notified of a significant food safety complaint
-
Submit to the applicable LEA the name and permit number of a kitchen operator if HomeTable receives three or more unrelated individual food safety complaints from verified consumers within any two-week period, within two weeks of the third complaint received

Kitchen operators acknowledge and agree that HomeTable may disclose their name, permit number, and relevant consumer purchase information to regulatory authorities as required by California law.

8. Prohibited Content and Conduct
​
Users of HomeTable, including kitchen operators, may not:
​

Use the word "catering," "caterer," "catered," or any variation of that word in any listing, description, profile, or publication on HomeTable
-
Advertise or promote third-party food delivery services in connection with any MEHKO listing, except as authorized under California Retail Food Code Section 114367.5(2)(b)
-
Submit false, inaccurate, misleading, or fraudulent permit information
-
List any kitchen operation that does not hold a valid permit from the applicable county environmental health agency
-
Use HomeTable for any unlawful purpose or in violation of any applicable law or regulation

9. Kitchen Operator Responsibilities

By listing a kitchen on HomeTable, kitchen operators represent, warrant, and agree that:
​

They hold a valid, current permit issued by the applicable county environmental health agency
-
All information submitted to HomeTable, including permit numbers, issuing agency names, descriptions, photos, and pricing, is accurate and truthful
-
They will promptly update their listing if their permit status changes, expires, or is revoked
-
They will comply with all applicable California laws, county ordinances, and health department requirements at all times
-
They will not use the word "catering" or any variation thereof in their listing
-
They will not advertise third-party delivery services in their listing except as permitted by law
-
They are solely responsible for all food preparation, food safety, customer interactions, and transactions
-
All payments, orders, and arrangements with diners are their sole responsibility

10. Diner Responsibilities
Â
By using HomeTable to find or connect with kitchen operators, diners acknowledge and agree that:

HomeTable is a discovery platform only and is not responsible for food quality, food safety, or the conduct of any kitchen operator
-
All arrangements, orders, payments, and pickup logistics are made directly with the kitchen operator
-
HomeTable does not guarantee the accuracy or current status of any listing, permit, or information displayed
-
Diners use HomeTable at their own risk and are responsible for independently verifying information before making any purchase

11. Disclaimer of Warranties
Â
HomeTable is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

HomeTable makes no warranties or representations regarding:

The accuracy, completeness, or reliability of any listing or information on the platform

The validity or current status of any permit or license displayed
-
The food safety practices of any kitchen operator
-
The quality, safety, or fitness of any food sold through connections made on HomeTable
-
The uninterrupted or error-free availability of the platform

12. Limitation of Liability
Â
To the fullest extent permitted by applicable law, HomeTable and its owners, operators, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

The use of or inability to use the HomeTable platform

Any food safety incident, foodborne illness, injury, or harm related to food purchased from any listed kitchen operator

The inaccuracy, expiration, or invalidity of any permit, license, or information displayed on the platform
-
Any transaction, arrangement, dispute, or interaction between diners and kitchen operators
-
Any act or omission of any kitchen operator or diner

13. Indemnification
Â
You agree to indemnify and hold harmless HomeTable and its owners, operators, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the HomeTable platform

Your violation of these Terms

Your violation of any applicable law or regulation

Any inaccuracy in information you provide to HomeTable
-
Any transaction or interaction between you and another user of the platform

14. Modifications to Terms
​
HomeTable reserves the right to modify these Terms at any time. When changes are made, the revised Terms will be posted on this page and the "Last Updated" date will be updated.

Your continued use of HomeTable after changes are posted constitutes acceptance of the revised Terms.
​
15. Governing Law
​
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
